1. What is an Eviction?

Eviction is the legal procedure a landlord must follow to remove a tenant from the landlord's property. Although there may be various types of evictions, the Clerk has information and forms available for residential evictions.

2. When can this form be used?

You are trying to remove someone from your home and there is an agreement for rent (verbal or in writing) between you and the person you are trying to remove.

3. Can I mail a copy to the other party?

The clerk’s office can do a certified mailing in an addition to the service of documents as long as you provide envelope(s) with stamps and a copy off all documents per defendant.

4. How long does the other party have to respond before I can file the other paperwork?

The defendant has 5 working days to turn in a response.

5. How many copies of the packet will I need?

You will need the originals of all forms to open the case and a copy per Defendant for service.

6. How do I deposit money for rent into my Eviction case?

The deposit plus court registry fees must be in cash, money order, cashier's check, or a check drawn on an attorney's trust account.  This deposit is to be made payable to the Citrus County Clerk of Court and Comptroller’s office and will be deposited into the court registry.

How much is the fee to deposit Money?

Pursuant to F.S. 28.24(10) (a), court registry fees apply to the deposited amount, and are calculated at 3% for the first $500 and 1.5% for the remaining amount.
